Knoxville DUI Attorneys

Being arrested for driving under the influence (DUI) can feel like your life is over, but it doesn’t have to be that way. Just because you’re facing DUI charges in Tennessee doesn’t mean that you are in fact guilty, which is why you should never admit any fault or guilt before you’ve had a chance to speak with an experienced defense attorney. Whether you yourself have been arrested or you are trying to help a loved one who’s in a jam, accessing as much legal information as possible is essential.

As the third largest city in Tennessee, Knoxville experiences its share of DUIs. It’s important to realize that although a law enforcement officer may be convinced that you were driving drunk, he or she may have not followed protocol during the arrest or interrogation procedure. Also, devices used to test blood alcohol concentration (BAC) may have been flawed or used improperly. In addition to implementing effective defense strategies, a skilled criminal defense lawyer in Knoxville will evaluate all possible ways in which law enforcement may have made mistakes in these areas as well as others.

The Cost of a DUI

According to the Tennessee Department of Safety & Homeland Security, one DUI conviction has the power to ring you up for as much as $5,000, if not more. Possible costs of a Tennessee DUI include the following:

Protecting Your License

The privilege of driving is the key to independence for a lot of people - driving gets you to and from work, for one thing. If you have no previous DUIs on your record and no other revocations or suspensions have been made against your driving record, then you may be able to get a restricted license. Here are the steps you would have to follow:

DUI Penalties

It surprises a lot of people when they find out that DUI applies to not only alcohol, but also any intoxicant, narcotic drug, or other drug that effects the central nervous system– including prescription or over-the-counter drugs.

A first offense for DUI in Tennessee may result in a $350-$1,500 fine; 24 hours-11 months 29 days in jail; driver’s license suspension for one year; and community service of picking up litter from a state highway for 24 hours while wearing an orange-colored vest that says, "I Am a Drunk Driver."

A second offense for DUI may lead to a $600-$3,500 fine; 45 days - 11 Months, 29 Days in jail; and driver’s license suspension for two years. If the second DUI conviction is within five years of the first, a person may be required to complete an Ignition Interlock Program in which they’re enrolled for six months after reinstatement of their license. In addition, a person’s vehicle may be seized and/or forfeited.

A third offense for DUI may result in a $1,100 - $10,000 fine; 120 days - 11 Months, 29 Days in jail; and a driver’s license suspension for 3-10 years.

A fourth offense may lead to a $3,000 - $15,000 fine; no less than 150 consecutive days in jail; and a driver’s license suspension for five years.
