False Imprisonment in Tennessee

In Tennessee a person commits false imprisonment when he or she "knowingly removes or confines another unlawfully so as to interfere substantially with the other's liberty." (T.C.A. Section 39-13-302). A removal or confinement is said to be "unlawful" if its is accomplished by force, threat or fraud or in the case of a person under the age of 13 or incompetent, if it is accomplished without the consent of a parent, guardian or other person responsible for the general supervision of the minor's or incompetent's welfare. (T.C.A. Section 39-13-301). False imprisonment is a Class A misdemeanor in Tennessee.

Kidnapping in Tennessee

The state of Tennessee recognizes three forms of kidnapping:

Kidnapping is false imprisonment plus exposing another person to a substantial risk of bodily injury or confining another in a condition of "involuntary servitude," which basically means to force a person to work (whether paid or unpaid).

Aggravated kidnapping (T.C.A Section 39-13-304) is false imprisonment committed:

Aggravated kidnapping is a Class B felony.

Especially aggravated kidnapping (T.C.A. Section 39-13-305) is the most serious of the kidnapping and is a Class A felony. Especially aggravated kidnapping is false imprisonment plus:
