According to T.C.A. ยง 39-13-522, rape of a child is the unlawful sexual penetration of a victim by the defendant or the defendant by a victim, if the victim is more than three years of age but less than thirteen years of age. Under Tennessee law, "unlawful sexual penetration" means sexual intercourse, fellatio, anal intercourse, any other intrusion, however slight, of any part of a person's body or of any object into the genital or anal opening of the victim's, the defendant's or any other person's body. The emission of semen is not required for a defendant to be found guilty of rape of a child or aggravated rape of a child.
Rape of a child is a Class A felony and requires a mandatory sentence not than 25 years and a fine of no more than $50,000.
Aggravated rape of a child is a Class A felony in the state of Tennessee. It is a violent sexual offense under the Tennessee Sexual Offender and Violent Sexual Offender Registration, Verification, and Tracking Act of 2004.
