Boating Accident Statistics

According to the Tennessee Wildlife Resources Agency's state boating statistics, there were a total of 159 boating accidents in 2008 alone. The greatest number of boating accidents occurred on the Ocoee River (22 accidents). The monetary amount of damage resulting from boating accidents in 2008 was $1.4 million, which is an increase of $946,000 from the previous year.

The leading type of accident was collision with another vessel, and the leading contributing factor of accidents was operator inattention followed closely by hazardous waters. Alcohol or drug use was a contributing factor in 12.5 percent of the boating accidents, which was an increase from 2007. The top contributing cause for fatal accidents was alcohol use.

Boating Accident Liability

As is evident from these statistics, a majority of boating accidents in TN occurred as a result of negligence (such as operator inattentiveness) or the violation of law (operating a boat or watercraft while under the influence of alcohol or drugs). These actions give rise to liability.

Other actions that give rise to liability include an operator's failure to maintain the boat or watercraft properly. A manufacturer of a boat or watercraft may also be liable for a product defect that cause or contributed to the boating accident.
