Problem Found with Tennessee Drunk Driving Law

It is a common misconception that you can avoid serious criminal penalties for driving while under the influence (DUI) as long as you do not cause an accident or injury. There are life-changing penalties in Tennessee for drunk drivers, and judges often impose the harshest penalties allowed under the law to deter repeat offenses.

A recent newspaper investigation uncovered a loophole in Tennessee DUI law. According to a news report in The Commercial Appeal, a person convicted of drunk driving without causing an accident can potentially face more jail time than a driver who causes a fatal accident while driving under the influence. Proponents of the law believe that it rightfully gives judges the ability to decide what types of penalties the defendant should face. Others, however, believe that the law unfairly punishes drunk drivers who did not cause an accident, and does not impose harsh enough punishment for those responsible for causing a fatal crash. Truck Driver Gets Prison Sentence after DUI Crash

A 41-year-old Tennessee man will serve between seven and 20 years in state prison after pleading no contest to two counts of aggravated assault for driving under the influence (DUI). According to a news report in Public Opinion Local News, he was sentenced at Franklin County Courthouse in connection with an accident that occurred back on November 19, 2013. Officials say he was driving a tractor-trailer while under the influence of peppermint schnapps when his rig struck two cars that were parked on the shoulder. The driver allegedly agreed to accept responsibility for the crash but then unsuccessfully attempted to withdraw his no contest plea.

You will not only face drunk driving charges if you are involved in an alcohol-related injury accident. The prosecution will likely file a number of different charges that all carry significant consequences.
