The Consequences of Driving While Under the Influence of Prescription Drugs

Driving under the influence of alcohol or illegal drugs (DUI) is against the law and can result in significant criminal penalties. Many Tennessee drivers are unaware that driving under the influence of prescription drugs can lead to DUI charges as well. According to a recent Fox 17 news report, the high rate of prescription drug use in Tennessee is leading to an influx in the number of impaired driving arrests.

A recent study reported in Forbes shows that a number of states in the south are well above the national average for prescription drug use. In fact, Tennessee ranked fourth in the nation for having the highest retail prescriptions filled per capita. This means that more people in Tennessee are currently taking prescription drugs than just about anywhere else in the nation. Can Breath Tests Be Challenged in Tennessee?

If you have been arrested on suspicion of driving under the influence (DUI) in Tennessee, you are likely feeling helpless and confused. You may feel as if your rights are being taken away from you. However, it is important to remember that you do have rights and that you can fight the charges in court. You do not have to accept a plea deal or even agree with the results of your breath test.

Police officers often administer breath tests to determine whether or not a driver is under the influence. When the test shows that the driver has a blood alcohol content (BAC) of 0.08 or above, he or she will likely be arrested and charged with a DUI.
